How To Price Your Art ATTENDANCE AGREEMENT (LM)

 

I am purchasing the How to Price Your Art: Pricing with Confidence for Sales & Profit Virtual Workshop  (the “Workshop”) conducted by Tommey Capital, LLC (“Tommey Capital”).  I am responsible for ensuring that I have read and understood the terms and conditions set forth in this Attendance Agreement (the “Agreement”).  By purchasing this workshop, I acknowledge and agree that (i) that I have read and understood this Agreement; (ii) that I have had an opportunity to ask Tommey Capital any questions about this Agreement, and (iii) that I agree to be bound by the terms and conditions set forth in this Agreement.

In consideration for my attendance at the Workshop, to which I agree that I am not otherwise entitled, I hereby agree as follows:

  1. I, on behalf of myself and my heirs, executors, administrators, assigns, and any and all other persons claiming by and through me, hereby covenant not to sue and fully and forever release Tommey Capital, LLC, and its officers, directors, shareholders, agents, members, employees, former employees, and representatives, and Matthew Tommey, and all of his heirs, executors, and agents (hereinafter collectively referred to as “Tommey Capital and Representatives”) from any and all claims, demands, damages, losses, actions, suits, causes of action, debts, costs, expenses, attorneys’ fees, judgments, and all other liabilities that may arise from my participation in the Workshop. This release extends to claims arising from any cause whatsoever, including but not limited to the negligence of Tommey Capital and Representatives, breach of contract, and/or products liability, excepting gross negligence or intentionally wrongful conduct.
  2. I hereby agree to hold harmless and indemnify (that is, defend and pay, including costs and attorneys’ fees) Tommey Capital and Representatives from liability for any claim, including damage to property or personal injury, illness, or death of any third party (including other attendees) arising from or in any way related to my participation in the Workshop. This indemnity includes claims arising from the negligence (excluding gross negligence or intentionally wrongful conduct) of Tommey Capital and Representatives.
  3. I hereby grant Tommey Capital and Representatives the right and permission to use, for any lawful purpose, including any Tommey Capital publication, publicity, advertisement, or education (collectively “Publication”), photographs, films, videotape, electronic representations, or sound recordings made of me during the Workshop, without payment or other consideration. I hereby waive any right that I may have to inspect or approve any Publication in I am presented.  I hereby release, discharge, and agree to hold harmless Tommey Capital and Representatives with respect to any and all claims, demands, and causes of action that I have or may have as a result of the Publication.  I agree that any Publication shall be the property of Tommey Capital and that Tommey Capital may use the Publication for any purposes anywhere in the world at its sole discretion.
  4. I acknowledge and agree that all intellectual property rights in and to the Workshop, including but not limited to materials distributed at or in connection with the Workshop and all trademarks used by Tommey Capital (e.g., Matt Tommey, Tommey Capital, Thriving Christian Artist Workshop, etc.), are owned by Tommey Capital. I will not use or reproduce, or allow anyone else to use or reproduce, any Workshop materials to which I may have access without the prior written authorization of Tommey Capital.  I further agree not to create derivative works, including developing my own educational materials, based upon the intellectual property of Tommey Capital.  While I may use Tommey Capital trademarks to describe my attendance of the Workshop, I shall not hold myself out as affiliated with, certified by, or otherwise associated with Tommey Capital.
  5. In the event that Tommey Capital, in its sole discretion, determines that my conduct is disruptive or otherwise interferes with attendees’ participation in the Workshop, Tommey Capital may dismiss me from the Workshop and demand that I leave the virtual platform at which the Workshop occurs. In the event that I am dismissed from the Workshop and/or the premises pursuant to this Section 5, any and all amounts I have paid to Tommey Capital for the Workshop will not be refunded.  Tommey Capital further reserves the right, in its sole discretion, to prohibit me from participating in or attending any future Workshops, presentations, or other events hosted by Tommey Capital.
  6. I understand and agree that the Workshop programs, any oral or written communications by Tommey Capital and Representatives, or any materials or other documents I receive as part of the Workshop or as a result of my attendance at the Workshop do not constitute any representation, guarantee, warranty, or prediction of any certain financial, commercial, artistic, monetary, or other results by me. I am completely and independently responsible for my own business and/or ventures, including but not limited to their financial success or failure.  Tommey Capital and Representatives are in no way responsible for the oversight, administration, maintenance, or operation of my business and/or ventures, and Tommey Capital and Representatives shall bear no liability whatsoever for any decisions, strategies, actions, or inactions by me or my business and/or venture.
  7. This Agreement shall in all respects be interpreted, enforced, and governed under the laws of Texas. I agree that this Agreement shall be binding upon and inure to the benefit of my heirs, personal representatives, successors, and assigns, and shall inure to the benefit of Tommey Capital and Representatives and its successors and assigns.  Each provision of this Agreement is intended to be severable.  If any provision or part of any provision of this Agreement shall for any reason be held invalid, unenforceable, or contrary to public policy or any law, then the remainder of this Agreement shall not be affected thereby.

         I have read and fully understand this Attendance Agreement as set forth above, including but not limited to the release of all claims.  I agree to be bound by its terms and conditions.
